Judge Grants Plaintiffs' Motion to Amend in Lawsuit Against Delta-T Group

On July 2, 2010, the Court in Bamgbose v. Delta-T Group denied Defendant's two motions to dismiss and granted Plaintiffs' motion to amend. In its order, the Court allowed an amendment adding opt-in John Harris as a named plaintiff on the complaint. The Court also permitted the addition of Delta-T's three owners and operators (Joanne McAndrews, Scott McAndrews, and Chris McAndrews), as individual defendants. Click here to view the Amended Complaint. The Court also rejected Defendant's attempts to dismiss the case on procedural grounds. Specifically, the Court found that the original named Plaintiff's judgment does not moot the entire case and that the opt-in Plaintiffs can presently remain together in the same action. We intend to soon submit a plan to the court showing how we wish to proceed in renewing our motion for certification. We are very pleased with the rulings on this latest string of motions and are excited to finally move forward with the case.
