NKA Wins Conditional Certification for Class of 22,000 Domino's Pizza Delivery Drivers

On Monday, June 21, 2010 our Motion for Conditional Class Certification was granted! Pending Court approval, Plaintiffs will send judicial notice of the right to join this lawsuit to approximately 22,000 Domino's delivery drivers nationwide.
This is a very exciting development in the case. Plaintiffs presented winning arguments for proceeding with this case as a collective action. The Court has found that delivery drivers as defined by the class are similar enough to join together in pursuing their federal minimum wage claims under the FLSA against Domino's Pizza, LLC. After judicial notice is sent out in this case, we will enter the second phase of discovery.
In addition, Plaintiffs are preparing to file a motion for class certification as to the proposed Rule 23 class in Minnesota. One of the central Minnesota state law claims in this lawsuit is that delivery drivers working at corporate Domino's stores within the last three years were unlawfully denied the right to keep the delivery fees Domino's imposed on its customers.
