New Vision Telecommunications Barred From Retaliating Against Plaintiffs

On December 14, 2009, Judge Robert L. Echols of the U.S. District Court for the Middle District of Tennessee entered a preliminary injunction barring New Vision Telecommunications Inc. and its management from retaliating against the named Plaintiffs in this lawsuit. The Judge had previously granted Plaintiffs request for a temporary restraining order requiring New Vision to give the Plaintiffs the same work they would have received before filing the suit and to post a notice informing all employees that they would not suffer retaliation if they joined the lawsuit. Defendants have since posted the FLSA's anti-retaliation requirements at the workplace. In granting Plaintiffs' request for a preliminary injunction, Judge Echols noted that the claims made by New Vision’s managers that the Plaintiffs were receiving less work due to performance was not credible and that it was evident that Plaintiffs would likely succeed on their claim of retaliation and would be irreparably harmed without the injunction in place.
